Terms of Service

These Terms of Service govern your use of Carmic Pro's AI video clipping and orchestration platform, including all related tools, APIs, and services.

1. Acceptance of Terms

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the service. These terms apply to all visitors, users, and others who access or use the Service.

2. Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

• You are responsible for safeguarding your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• You may not use another user's account without permission.
• One individual may not maintain more than one free account.

3. Subscriptions & Billing

Paid features are billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring basis (monthly or annually), depending on the billing cycle you select.

• Free trials last 7 days unless otherwise stated.
• You may cancel at any time. Access continues until the end of the billing period.
• Refunds are available within 14 days of initial purchase if fewer than 30 processing minutes have been used.
• Processing minutes do not roll over between billing cycles.
• Price changes will be communicated 30 days in advance via email.

4. Content Ownership

You retain full ownership of all content you upload and all clips generated from your content. Carmic Pro does not claim any intellectual property rights over your videos, clips, captions, or exports. You grant us a limited, non-exclusive license solely to process your content as required to provide the Service.

5. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To generate violent, sexually explicit, or hateful content.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• To upload content you do not have the right to use or distribute.
• To abuse API rate limits or circumvent usage quotas.
• To reverse-engineer, decompile, or attempt to extract our AI models or algorithms.

6. Service Availability

We target 99.9% uptime for Business and Enterprise plans. Scheduled maintenance windows will be communicated 48 hours in advance. We are not liable for downtime caused by force majeure events, third-party service outages, or user-side connectivity issues.

7. Limitation of Liability

In no event shall Carmic Pro, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

8. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination.

9. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Berlin, Germany.
